why is there an asterisk next to the noise reduction rating (NRR)* ? I have used page search to look for the accompanying fine print and there is none

My opinion is the decibal rating is different in a controlled environment vs in the field.

Can you hear birds through them?

I wanted to find something I could wear to reduce noise in the gym (but I don't want a music headset). Would these stay on while working out?

I'm sure they would. I work out and, having worn them for other things, can tell you that they'll stay on. And, I think they're comfortable. Very nice for the price. If you think you'd like to wear something like this at the gym...go for it.

Why does it require to verify I am a professional/contractor?

I'm no expert, but judging from the low NR rating, my guess is that these would not prevent hazardous levels of noise in many circumstances.
